損壞理賠制度

Damage Indemnification Policy

前言

Preface

本協議(下稱「本協議」)旨在規範委託人與受託方(本公司)間因搬運服務所生之物品損壞賠償責任及其相關事宜。委託人於接受本公司服務前,應詳閱本協議全部條款內容。委託人與本公司間之權利義務關係,悉依本協議之約定。

This Agreement (hereinafter referred to as the "Agreement") is intended to govern the liability for damage to property and related matters arising from moving services provided by the Service Provider (the "Company") to the Client. Prior to accepting the Company's services, the Client shall thoroughly review all provisions of this Agreement. The rights and obligations between the Client and the Company shall be governed exclusively by the provisions herein.

委託人對本協議有任何疑問,得於服務時間內(09:00-18:30)致電客戶服務專線(0981-379-892)或透過官方Line (@1417moving) 尋求解釋及說明。

Should the Client have any inquiries regarding this Agreement, the Client may contact the customer service hotline (0981-379-892) or the official Line account (1417) during business hours (09:00-18:30) for clarification and explanation.

第一條 損壞通知期限
Article 1: Notification Period for Damage

1.1 委託人應於搬運服務完成後三(3)日內,以書面或電子通訊方式通知本公司關於任何搬運物品之毀損情事。

1.1 The Client shall notify the Company in writing or by electronic communication of any damage to transported items within three (3) days following the completion of moving services.

1.2 若搬運物品之毀損或滅失非易於發現者,委託人應於搬運完成後十(10)日內,將該等情事通知本公司。

1.2 In the event that damage to or loss of transported items is not readily discoverable, the Client shall notify the Company of such circumstances within ten (10) days following the completion of moving services.

1.3 委託人逾前述期限未為通知者,視為放棄對本公司請求損害賠償之權利。

1.3 The Client's failure to provide notification within the aforementioned periods shall be deemed a waiver of the right to claim compensation from the Company.

第二條 賠償責任範圍
Article 2: Scope of Liability

2.1 本公司之賠償責任僅限於本公司人員在執行搬運作業過程中所直接造成之物品損害。

2.1 The Company's liability for compensation shall be limited to direct damage to items caused by the Company's personnel during the execution of moving operations.

2.2 若本公司人員於搬運前已明確告知委託人特定物品存在損壞風險,而委託人仍堅持搬運該物品者,因此所生之任何損害,本公司不負賠償責任。

2.2 If the Company's personnel have explicitly informed the Client of potential risks of damage to specific items prior to moving, and the Client nevertheless insists on proceeding with the transportation of such items, the Company shall bear no liability for any resulting damage.

第三條 損壞賠償標準
Article 3: Damage Compensation Standards

3.1 物品損壞之賠償範圍僅限於搬運過程中造成之新增外觀損傷(不包含純搬運過程中產生之輕微磕碰)。

3.1 Compensation for damaged items shall be limited to new external damage occurring during the moving process (excluding minor dents and scratches inherent to the normal moving process).

3.2 物品損壞之賠償原則以修繕為主,惟修繕費用超過該物品折舊後現值者,本公司得選擇以折舊後現值賠付之。

3.2 The principle of compensation for damaged items shall be repair; however, if the cost of repair exceeds the depreciated current value of the item, the Company may elect to compensate based on the depreciated current value.

第四條 物品遺失之賠償
Article 4: Compensation for Lost Items

4.1 物品遺失之賠償,委託人應提供該物品之價值證明文件(如發票等),本公司將依該物品之使用年限折舊後之價值進行賠償。

4.1 For compensation of lost items, the Client shall provide documentary evidence of the item's value (such as invoices). The Company shall compensate based on the depreciated value of the item according to its period of use.

4.2 賠償金額之上限:

  • 4.2.1 純搬運服務之單次搬遷案件,賠償上限為新臺幣壹萬元整(NT$10,000)。

  • 4.2.2 包含打包與搬運之單次搬遷案件,賠償上限為當次服務費用總額(不含包材費用)

4.2 Compensation limits:

  • 4.2.1 For single moving operations involving transportation only, the maximum compensation shall be Ten Thousand New Taiwan Dollars (NT$10,000).

  • 4.2.2 For single moving operations involving both packing and transportation, the maximum compensation shall be the total service fee for that operation (excluding packing material costs).

第五條 自行打包之責任歸屬
Article 5: Responsibility for Self-Packed Items

5.1 委託人自行打包之箱內物品,委託人應自行負責妥善保護。若搬運過程中無明顯碰撞或外力重擊之情形,本公司不對箱內物品之安全承擔責任。

5.1 For items packed by the Client, the Client shall be responsible for adequate internal protection. In the absence of evident collision or external impact during transportation, the Company shall not be liable for the safety of contents within such packaged items.

第六條 貴重物品之除外責任
Article 6: Exclusion of Liability for Valuables

6.1 下列貴重物品不在本公司賠償範圍內,委託人應自行妥善保管並運送:

  • (a) 現金、支票、有價證券;

  • (b) 珠寶、手錶及其他貴重配飾;

  • (c) 重要文件,包括但不限於證件、證書、印章、存摺及公文;

  • (d) 古董、字畫、藝術品;

  • (e) 高價電子產品,如手機、隨身碟等小型電子設備;

  • (f) 其他具個人紀念性且體積小之物品。

6.1 The following valuable items are excluded from the Company's compensation coverage, and the Client shall personally safeguard and transport such items:

  • (a) Cash, checks, and negotiable securities;

  • (b) Jewelry, watches, and other valuable accessories;

  • (c) Important documents, including but not limited to identification documents, certificates, seals, passbooks, and official documents;

  • (d) Antiques, calligraphy, paintings, and artworks;

  • (e) High-value electronic products, such as mobile phones, USB drives, and other small electronic devices;

  • (f) Other small items of personal sentimental value.

第七條 高價值物品之特殊約定
Article 7: Special Provisions for High-Value Items

7.1 高單價藝術品或家具應採用訂製木箱或專業包裝方式搬運,委託人若未依本公司建議而堅持以一般方式搬運者,因此所生之任何損害,本公司不負賠償責任。

7.1 High-value artworks or furniture shall be transported using custom-made wooden crates or professional packing methods. Should the Client disregard the Company's recommendations and insist on transportation by conventional means, the Company shall bear no liability for any resulting damage.

第八條 確認義務
Article 8: Verification Obligations

8.1 所有物品均依委託人指示搬運與擺放,委託人應於搬運過程中確認車輛裝載情形,並於搬運完成後確認車輛已完全卸空。

8.1 All items shall be transported and placed according to the Client's instructions. The Client shall verify the loading status during transportation and confirm that the vehicle is completely unloaded upon completion of the moving service.

8.2 委託人經本公司人員告知而未履行前項確認義務者,視為放棄確認權利。任何後續爭議,以完工後委託人之簽章為雙方合意之最終依據。

8.2 If the Client fails to fulfill the verification obligations specified in the preceding paragraph after being instructed to do so by the Company's personnel, the Client shall be deemed to have waived the right of verification. Any subsequent disputes shall be resolved based on the Client's signature upon completion of work as the final agreement between the parties.

第九條 電器設備之特別規定
Article 9: Special Provisions for Electronic Equipment

9.1 電器、家電、電子儀器及電腦設備等物品,若外觀無明顯損壞跡象,而僅有內部功能異常者,因損壞原因難以認定,本公司不接受對該等物品內部損壞之賠償請求。

9.1 For electronic appliances, household electronics, electronic instruments, and computer equipment with no visible external damage but exhibiting internal functional abnormalities, the Company shall not accept claims for compensation for internal damage due to the difficulty in determining the cause of such damage.

第十條 大型物品內容物之免責聲明
Article 10: Disclaimer for Contents of Large Items

10.1 委託人應於搬遷日前將大型物品內之貴重物品移出。搬遷時,本公司對大型物品內之任何物件不負保管或賠償責任。

10.1 The Client shall remove valuable items from within large objects prior to the moving date. During the moving process, the Company shall bear no custodial or compensatory responsibility for any items contained within large objects.

本協議條款構成委託人與本公司間完整之協議,並取代雙方先前之任何口頭或書面承諾。

This Agreement constitutes the entire agreement between the Client and the Company and supersedes any prior oral or written undertakings between the parties.
