1.1 本合約於客戶(以下簡稱「甲方」)向移室宜居家居空間有限公司(以下簡稱「乙方」或「1417」)支付訂金時即告成立,甲方視為已充分了解並完全同意本合約全部條款。
1.1 This Agreement shall be deemed established upon the Customer (hereinafter referred to as "the Client") remitting a deposit to 1417 Ideal Moving Co., Ltd. (hereinafter referred to as "the Company" or "1417 Ideal Moving"). The Client shall be deemed to have fully understood and completely agreed to all terms and conditions of this Agreement.
1.2 訂金金額規定如下:
- 整理服務:每位整理專員新台幣壹仟元整(NT$1,000)
- 搬遷服務:每次服務新台幣伍仟元整(NT$5,000)
- 現場勘查:每次勘查新台幣貳仟元整(NT$2,000)
1.2 The deposit amounts are stipulated as follows:
- Organizing Service: New Taiwan Dollars One Thousand (NT$1,000) per organizing specialist
- Relocation Service: New Taiwan Dollars Five Thousand (NT$5,000) per service
- On-site Inspection: New Taiwan Dollars Two Thousand (NT$2,000) per inspection
2.1 甲方因個人因素無法依原定日期接受服務時,乙方提供下列服務調整方案:
2.1.1 甲方應主動聯繫乙方客戶服務中心,雙方應共同協商替代服務時間。
2.1.2 若甲方暫無服務需求,乙方應保留甲方之訂金,保留期限自原定服務日起計算,不超過三百六十五(365)日。前述訂金可於保留期限內用於預約任何乙方提供之服務,包括但不限於「廢棄物清理服務」。
2.1 When the Client is unable to receive services on the originally scheduled date due to personal circumstances, the Company shall provide the following service adjustment options:
2.1.1 The Client shall proactively contact the Company's Customer Service Center, and both parties shall jointly negotiate an alternative service time.
2.1.2 Should the Client have no immediate service requirements, the Company shall retain the Client's deposit for a period not exceeding three hundred and sixty-five (365) days from the originally scheduled service date. The aforementioned deposit may be utilized within the retention period to schedule any services provided by the Company, including but not limited to "Waste Disposal Services."
3.1 甲方欲變更任何搬遷或整理服務之內容或時間,應於原定服務日前至少五(5)個日曆日以書面或電子方式通知乙方客戶服務中心。甲方未能於規定期限內提供前述通知者,視為甲方單方面取消服務,訂金不予退還。
3.1 Should the Client wish to modify the content or timing of any relocation or organizing service, the Client shall notify the Company's Customer Service Center in writing or electronically no less than five (5) calendar days prior to the originally scheduled service date. Failure by the Client to provide the aforementioned notification within the stipulated timeframe shall be deemed a unilateral cancellation of service by the Client, and the deposit shall be non-refundable.
3.2 甲方於距離原定服務日期五(5)日以上時申請之首次改期,乙方同意免收服務調整費用。若甲方需進行第二次或以上之改期,乙方將自甲方已付訂金中扣除新台幣伍佰元整(NT$500)作為行政處理費用。若訂金餘額不足,甲方應補繳差額以維持預約效力。
3.2.1 計算範例:服務預定於十月十日上午九時進行,則甲方之通知最遲應於十月五日上午九時前送達乙方。若甲方於期限內通知,訂金將依本合約第二條第1.2項保留。若甲方未能於前述期限內通知,甲方需重新支付訂金以確保後續服務預約之效力。
3.2 For the first rescheduling request made by the Client at least five (5) days prior to the originally scheduled service date, the Company agrees to waive any service adjustment fee. Should the Client require a second or subsequent rescheduling, the Company shall deduct New Taiwan Dollars Five Hundred (NT$500) from the Client's remitted deposit as an administrative processing fee. In the event that the deposit balance is insufficient, the Client shall remit the difference to maintain the validity of the reservation.
3.2.1 Calculation Example: If service is scheduled for 9:00 a.m. on October 10, the Client's notification must be received by the Company no later than 9:00 a.m. on October 5. If the Client provides notification within the stipulated timeframe, the deposit shall be retained in accordance with Article 2, Section 1.2 of this Agreement. Should the Client fail to provide notification within the aforementioned timeframe, the Client shall be required to remit a new deposit to ensure the effectiveness of subsequent service reservations.
4.1 甲方僅得於下列情形下要求乙方退還已付訂金:
4.1.1 不可抗力事件:因天災、政府命令或其他不可抗力事由致使服務無法進行時,甲方可聯繫乙方客戶服務中心申請變更或退款。
4.1.2 提前取消:甲方於原定服務日前至少五(5)個日曆日提出書面取消通知。
4.1 The Client may only request that the Company refund the remitted deposit under the following circumstances:
4.1.1 Force Majeure Events: When service delivery is rendered impossible due to natural disasters, government orders, or other force majeure causes, the Client may contact the Company's Customer Service Center to request modification or refund.
4.1.2 Advance Cancellation: When the Client submits written cancellation notice at least five (5) calendar days prior to the originally scheduled service date.
4.2 甲方申請退款時,應向乙方提供完整銀行帳戶資料。乙方退還訂金時將扣除新台幣壹拾伍元整(NT$15)作為銀行轉帳手續費。
4.2 When applying for a refund, the Client shall provide complete banking account information to the Company.The Company shall deduct New Taiwan Dollars Fifteen (NT$15) from the refunded deposit as a bank transfer processing fee.
5.1 雙方明確認知並同意,乙方所提供之服務屬「不可逆服務性質」,一經提供即告完成,乙方不接受任何形式之退款申請。
5.1 Both parties explicitly acknowledge and agree that the services provided by the Company are of an "irreversible nature"; therefore, once rendered, they shall be deemed complete, and the Company shall not accept refund applications in any form.
5.2 若甲方於服務進行期間對服務內容有任何疑慮,應立即向乙方指派之專業人員提出,俾進行必要之調整。對於未能現場解決之事項,甲方應以書面方式聯繫乙方客戶服務團隊。
5.2 Should the Client have any concerns regarding service content during service delivery, such concerns shall be immediately raised with the professional personnel assigned by the Company to facilitate necessary adjustments. Regarding matters that cannot be resolved on-site, the Client shall contact the Company's Customer Service Team in writing.
6.1 乙方保留對本合約條款之最終解釋權。
6.1 The Company reserves the final right of interpretation regarding the terms and conditions of this Agreement.
6.2 乙方有權隨時調整或變更本合約內容,修改後之合約自公告日起生效。
6.2 The Company reserves the right to adjust or modify the content of this Agreement at any time. The modified Agreement shall take effect from the date of announcement.
6.3 本合約之任何條款如經法院認定無效或不可執行,不影響其餘條款之效力。
6.3 If any provision of this Agreement is deemed invalid or unenforceable by a court, it shall not affect the validity of the remaining provisions.
7.1 因本合約所生之任何爭議,雙方應本誠信原則先行協商解決。
7.1 Any disputes arising from this Agreement shall be initially resolved through good faith negotiations between both parties.
7.2 若協商不成,雙方同意以臺灣臺北地方法院為第一審管轄法院。
7.2 If negotiations fail, both parties agree that the Taiwan Taipei District Court shall be the court of first instance with jurisdiction.
